Terms of Service

1. Eligibility

You must be at least 18 years old to create an account and use the Service. By using CassouFit you represent that you are 18 or older and legally able to enter into these Terms. The Service is not directed to children under 18.

2. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it current. Notify us immediately at support@cassoufit.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Health acknowledgment

CassouFit provides general fitness and nutrition guidance and coaching content. It is not medical advice and is not a substitute for professional medical care. Before beginning any exercise or nutrition program, you should consult a physician. By using the Service you accept and agree to the separate Health & Fitness Disclaimer, which is incorporated into these Terms by reference. You participate in all activities at your own risk.

4. Subscriptions, billing, and cancellation

Access to certain features requires a paid subscription. Current pricing is shown on the plan selection screen before you are charged, and on your receipt. By subscribing you authorize us and our payment processor (Stripe) to charge your payment method on a recurring basis until you cancel. Subscriptions auto-renew at the end of each billing period at the then-current price unless cancelled beforehand.

You may cancel at any time from your account settings or by contacting support@cassoufit.com; cancellation stops future charges and takes effect at the end of the current billing period. Refunds: no refunds for partial billing periods; cancel any time to stop future charges. We may change prices with advance notice; changes apply to the next billing period. We use Stripe to process payments and do not store your full card details ourselves.

5. Acceptable use

You agree not to: (a) share, resell, or redistribute Service content, including workout videos, plans, and materials; (b) copy, scrape, or reverse-engineer the Service; (c) use the Service for any unlawful purpose; (d) upload harmful code or attempt to disrupt the Service; or (e) share your account with others. Workout videos and content are licensed to you for personal, non-commercial use only.

6. Intellectual property

All content on the Service — including exercise videos, images, coaching cues, program structures, text, branding, and software — is owned by Maestro Media Group, Inc. or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to access and use the Service for your own personal fitness use. No other rights are granted.

7. User-provided information

During onboarding and use, you may provide information about your fitness level, goals, injuries, and preferences. You represent that this information is accurate to the best of your knowledge and understand that the guidance you receive is generated from what you provide. See the Privacy Policy for how we handle this information.

8. Assumption of risk and release

Physical exercise carries inherent risks, including risk of injury. To the fullest extent permitted by law, you voluntarily assume all risks associated with using the Service and performing any exercises, and you release Maestro Media Group, Inc., its owners, employees, contractors, and Cassou from any claims, liabilities, or damages arising out of your use of the Service or participation in any activity, except to the extent caused by our gross negligence or willful misconduct. This is further detailed in the Health & Fitness Disclaimer.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that any particular fitness or health result will be achieved. Individual results vary.

10. Limitation of liability

To the fullest extent permitted by law, Maestro Media Group, Inc. and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Maestro Media Group, Inc. from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and assumption of risk) will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you (for example by email or in-app notice). Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the courts located in the State of Florida, USA for any dispute not subject to arbitration.
